TutorTech Terms of Service

Important information about using TutorTech
Please read these Terms of Service ("Terms") before using the TutorTech website, learning platform or any of the services and features we make available through TutorTech.
We have written these Terms to be as clear as possible. Some services also have their own additional terms, which we will show or link to when they apply.
1. About these Terms
Who we are
TutorTech Ltd ("TutorTech", "we", "us") is a company registered in England and Wales.
What these Terms cover
These Terms apply to the TutorTech website, learning platform, Tutor profiles, one-to-one tutoring, TutorTech Classes, the Resource Hub, Courses, Channels, private microsites and related services (together, the "Services").
By creating an account, making a purchase, booking a service or continuing to use the Services, you agree to these Terms and any additional policies or product terms that apply to the feature you are using.
If a Tutor, contractor, Affiliate or other business user has a separate signed agreement with TutorTech, that agreement also applies and takes priority on the specific matters it covers.
What this means for you
Please make sure you understand which TutorTech service you are using and who is supplying it. We explain this below and will also show the relevant information on the booking, listing or checkout where appropriate.
2. Who can use TutorTech
TutorTech is used by Customers, Students, Tutors, Educator Creators, Affiliates and visitors.
· Customers and other people entering into contracts through TutorTech must be 18 or over.
· Students under 18 may use age-appropriate features through an account or learning environment set up or authorised by a Parent/Guardian or another authorised adult.
· Tutor applicants must complete TutorTech onboarding and sign the current Tutor Agreement before they can provide Tutor Services or use enabled Creator Features.
· You must keep your account details accurate, keep your login details secure and tell us promptly if you think someone has accessed your account without permission.
· We may require identity, qualification, safeguarding, payment or other checks that are appropriate to your role and the service you want to use.
3. Who provides each service?
TutorTech offers different types of services. The legal supplier can differ depending on what you book, buy or subscribe to.
One-to-one Tutor Services
For most one-to-one Tutor bookings, the independent Tutor is the supplier of the tutoring service unless the booking page says otherwise. The Tutor sets the price, availability and service description. TutorTech provides the platform, booking, payment, administrative and safeguarding infrastructure.
TutorTech Classes
TutorTech is the supplier of TutorTech Classes. We may engage suitably approved independent contractors to teach those Classes. Customers pay TutorTech, not the individual Class contractor.
Resources
A Tutor-created Resource in the Resource Hub is normally supplied by the Tutor seller unless the listing says otherwise. The Resource Hub, Courses & Channels Terms & Conditions and the Copyright and Intellectual Property Policy also apply.
Courses and Channels
For a Course or Channel, the supplier is the party identified on the product page and checkout. The Resource Hub, Courses & Channels Terms & Conditions and the Payment and Cancellation Policy explain the additional rules.
Why this matters
The supplier is responsible for the service or content they supply. TutorTech remains responsible for TutorTech's own platform services and for TutorTech-provided Classes.
4. Tutors and Educator Creators
Only Tutors approved by TutorTech may offer Tutor Services. Creator Features such as Resource Hub selling, Courses and Channels are enabled separately and may require additional qualification, identity, safeguarding, content or quality checks.
A "DBS checked" label is used only where the relevant UK DBS check has actually been completed. Approved international safeguarding or police checks may be described differently so that users are not misled.
We do not guarantee that a particular Tutor, Creator, Course, Channel or Class will remain available indefinitely. If a paid Customer right is affected, TutorTech or the relevant supplier will provide any remedy required by the applicable contract and law.
5. Prices, bookings, purchases and subscriptions
Prices and payment
The price, billing basis, supplier and any recurring charge will be shown before you buy, book or subscribe. Payments are processed through supported payment providers. TutorTech does not store your full payment-card details.
Channel subscriptions
A Channel subscription renews at the price and frequency shown at checkout until you cancel it. Unless the checkout or mandatory law says otherwise, cancelling stops the next renewal and you keep access until the end of the period you have already paid for.
Courses
A Course may be sold as a one-off purchase, for a stated access period, or as part of an active Channel. The product page and checkout explain the access basis. Buying a Course gives you a licence to access and use it as described; it does not transfer ownership of the Course content.
Immediate digital access
Some digital content is supplied immediately. Where the law requires it, we will ask you to expressly request immediate access and acknowledge any effect this has on a statutory cancellation right. Your statutory rights for faulty, unavailable or misdescribed digital content are not affected.
6. Channels, live Q&A and community features
A Channel gives you the content and features described on its listing. This may include Courses, Resources, scheduled live Q&A, comments or other educator support.
· If a listing promises something specific, such as new content each week, that promise forms part of the product description while it is displayed.
· Live Q&A and response features are educational support features. They are not emergency, medical, therapeutic or crisis services.
· Students should not post unnecessary personal information in Q&A, comments or community areas.
· Communication involving under-18s must remain within TutorTech-approved channels.
· We may moderate, remove or restrict content or communications for safeguarding, legal, quality or platform reasons.
7. TutorTech Classes
TutorTech is the supplier of TutorTech Classes to Customers. We set the Class description, schedule, pricing and cancellation terms shown through the platform. We may use suitably approved independent contractors to deliver Classes, but those contractors are paid by TutorTech rather than directly by Customers.
8. Resources
Resources are governed by the TutorTech Resource Hub, Courses & Channels Terms & Conditions. Unless a Resource listing says otherwise, the Tutor seller is the supplier of a Tutor-created Resource and TutorTech provides the platform, payment and access infrastructure.
When you buy a Resource, you receive a licence to use it in the way described by the listing and applicable terms. You do not become the owner of the copyright.
9. Using TutorTech safely and fairly
You must follow the User Code of Conduct and Safeguarding Policy.
In particular, do not use TutorTech for harassment, exploitation, grooming, cheating, unlawful content, intellectual-property infringement, fraud, scraping, payment avoidance, unauthorised data collection or off-platform solicitation of children.
10. Content and intellectual property
TutorTech content
TutorTech owns or licenses the website, software, branding and other TutorTech-created platform content. You may use this content only as allowed by these Terms or another licence we give you.
Tutor and Creator content
Tutors and Educator Creators normally keep ownership of the original content they create, subject to third-party rights and any separate written agreement. The Copyright and Intellectual Property Policy, Resource Hub, Courses & Channels Terms & Conditions and Tutor Agreement contain the more detailed rules.
You must not copy, redistribute, resell, scrape, republish or use TutorTech or Creator content to train AI systems or build datasets unless the applicable licence or a separate written agreement expressly allows it.
Content you submit
You keep ownership of original content you create and submit to TutorTech, subject to any third-party rights and any separate agreement that applies.
When you upload, post, submit or otherwise make content available through TutorTech, you give TutorTech a non-exclusive, worldwide, royalty-free licence to host, store, back up, reproduce, display, process, transmit, moderate and otherwise use that content only as reasonably necessary to operate, provide, secure and administer the Services and the purpose for which you submitted it.
If the content is intended to be public, such as a public profile, review, rating, comment or listing, this includes displaying it to the intended audience and making reasonable technical or formatting changes. If the content is private, such as a message, support request or document provided for a booking or complaint, our use is limited to providing the relevant service, safeguarding, security, support, moderation, complaint handling, legal compliance and record keeping.
We may allow contracted service providers acting on our behalf to process content where this is reasonably necessary to provide, secure or support the Services and appropriate contractual, confidentiality and data-protection requirements apply.
We may keep copies where reasonably necessary to support an existing purchase or subscription, resolve a dispute, investigate a safeguarding or intellectual-property concern, comply with law or protect platform integrity.
This licence does not transfer ownership of your content to TutorTech. It also does not allow TutorTech to sublicense your content to third-party AI models, LLM providers, external datasets or unrelated technology partners for model training or external commercial dataset use unless you have separately agreed to that use in writing.
11. Privacy and children's information
We process personal data as explained in the Data Privacy Policy. Because children may use TutorTech, we take particular care with safeguarding, data minimisation, privacy settings and how information is shared.
Customers are responsible for giving us accurate Parent/Guardian and Student information and for managing authorised access to a child's account or learning environment.
12. How we contact you
Service communications
We may contact you by email, SMS or through the platform about your account, verification, Tutor application, bookings, Classes, purchases, subscriptions, payments, security, safeguarding and other important service information. These are service communications and are separate from marketing.
Marketing
Marketing messages are handled separately. We send them only where permitted by law and provide an easy way to opt out. Where a separate marketing choice is required, it will not be bundled into acceptance of these Terms. The Data Privacy Policy explains this in more detail.
13. Session recording
We do not rely on a general statement that simply attending a session always means you have consented to recording. If recording is enabled for a particular service, we will provide the notice, choice or other lawful basis required for that use.
Users must not independently record, photograph, screenshot or redistribute child-facing sessions or communications unless TutorTech has expressly authorised it and all relevant legal and safeguarding requirements have been met.
14. Cancellations, refunds and payment disputes
The Payment and Cancellation Policy explains how cancellations, refunds, chargebacks and failed payments work. Product-specific information shown at checkout forms part of the contract for that purchase.
Nothing in these Terms reduces any statutory consumer rights that apply to you.
15. Service availability and changes
We maintain and update the platform from time to time and cannot promise that it will always be available without interruption.
We will take reasonable steps to minimise material disruption. If a paid service cannot be provided as agreed, you may be entitled to a replacement, price reduction, refund or another remedy under the applicable contract and law.
16. Reviews, rankings and recommendations
TutorTech may display reviews, ratings, search rankings and recommendations. These may take account of factors such as subject, availability, profile completeness, location, language, engagement and previous platform activity.
A recommendation is not a guarantee that a particular Tutor or product will be the best option for every Student. Reviews must be genuine and must not be manipulated.
17. Third-party links and services
TutorTech may contain links to websites, apps or services that we do not operate. We may also use third-party providers to support payments, learning technology, communications, hosting or other parts of the Services.
What this means for you
· A link to an external website or third-party product does not mean TutorTech endorses it unless we expressly say so.
· External websites and services may have their own terms and privacy notices, so please review them before using them.
· Where a third-party provider is acting for TutorTech as part of the Services, our Data Privacy Policy explains how personal information is handled.
· We are not responsible for the content or availability of an external website that is outside our control, but this does not affect any responsibility TutorTech has for a service that we have agreed to provide to you.
18. Your account is personal
Your TutorTech account is for you and must not be sold, transferred or given to another person. You must not share login details or allow someone else to use your account unless TutorTech has expressly enabled an authorised family, school or organisation access feature.
If we believe an account has been transferred, shared improperly or accessed without permission, we may restrict access while we investigate and protect the account.
19. Feedback you give us
We welcome suggestions about how TutorTech could work better.
If you voluntarily send us ideas, comments or suggestions about improving TutorTech, you allow us to use that feedback to develop and improve our Services without having to pay you for the idea itself.
This does not change the ownership or licence rules for Tutor, Creator or other content that you upload for teaching, sale, publication or another defined platform purpose, and it does not change how we handle personal information under the Data Privacy Policy.
20. Educational outcomes
TutorTech is designed to support learning, but educational progress depends on many factors outside the control of TutorTech, Tutors and Educators.
Unless a specific product or service description expressly promises otherwise, TutorTech, independent Tutors and Educator Creators do not guarantee a particular grade, examination result, school or university admission decision, qualification, SEND outcome or other learning result.
This does not reduce any obligation to provide services with the skill, care and quality required by the applicable contract and law, and it does not reduce your statutory consumer rights.
21. Using TutorTech outside the UK
TutorTech may be accessible from countries outside the UK, but not every Service, feature, payment method or product will be available everywhere.
We may restrict or refuse access where this is required by applicable law, sanctions, export controls, payment-provider requirements, safeguarding considerations or because a Service is not supported in a particular location.
If you use TutorTech from outside the UK, mandatory local laws may also apply. Nothing in these Terms removes rights that cannot legally be excluded in your country of residence.
22. How these Terms fit with other TutorTech terms
These Terms work together with the policies, product terms and separate agreements that apply to the Service you are using.
If there is a conflict, a specific product term or separate signed agreement takes priority for the particular matter it expressly covers. The remaining parts of these Terms continue to apply.
If any part of these Terms is found to be invalid or unenforceable, the rest of the Terms will continue to apply as far as the law allows.
TutorTech may transfer its rights or obligations under these Terms to another company as part of a reorganisation, financing, sale or transfer of the business, provided this does not reduce any mandatory consumer rights or materially disadvantage you without any notice or remedy required by law.
23. Suspension and closing accounts
We may restrict or suspend an account or feature where reasonably necessary to deal with safeguarding, legal, fraud, payment, security, infringement or serious policy concerns. We may act immediately where this is needed to protect a child or another user.
You may close your account, subject to any open purchases, subscriptions, disputes and legal record-retention requirements.
24. Responsibility and liability
Nothing in these Terms excludes liability that cannot lawfully be excluded or reduces mandatory consumer rights.
Subject to that, TutorTech is not responsible for indirect or unforeseeable loss that was not caused by our breach. This does not affect liability for death or personal injury caused by negligence, fraud or any other liability that cannot legally be excluded.
Where an independent Tutor or Educator is the supplier, that supplier remains responsible for the services or content they supply. TutorTech remains responsible for its own platform services and TutorTech-provided Classes.
25. Complaints and disputes
If something goes wrong, please contact support@tutortech.co.uk first so we can try to resolve it.

Nothing in these Terms prevents a consumer from using any statutory complaint, alternative dispute resolution or court route available to them.
26. Changes to these Terms
We may update these Terms for legal, regulatory, safeguarding, security, platform or product reasons. We will provide any notice required for material changes affecting an active paid product or subscription.
If a material change requires you to agree again, we will ask for fresh acceptance through an appropriate account or onboarding process.
27. Governing law and contact
These Terms are governed by the law of England and Wales, subject to any mandatory consumer rights that apply in your country of residence.
